MM will not provide any services without Client first signing this agreement.

1. Client agrees to pay sitter for hours worked including, but not limited to, the four hour minimum and mileage as applicable and any extra fees such as the rush fee, multiple family fee, parking fees, etc.

2. Client understands that Munchkin Minders is a referral agency, and not an employer of the Sitters/Nannies we work with. While each sitter is carefully interviewed and screened, Munchkin Minders accepts no responsibility for any loss or injury to client and/or client’s property due to the Sitter/Nanny’s actions, negligence or willful misconduct. Client agrees to waive any and all claim(s) against Munchkin Minders and it’s Owners for damages caused, directly or indirectly, by Sitter/Nanny. Client accepts all responsibility and risks to Client, Client’s family and/or personal property for injury or loss, arising out of or related to having engaged Sitter’s services.

3. Client agrees to leave emergency contact information for Sitter/Nanny so that Client can be reached at all times.

4. For on-call assignments, if an interview is requested prior to commencement of the assignment, client agrees to pay Sitter $15.00 for the 1 hour interview.

5. For all assignments, a booking fee/deposit will be paid to Munchkin Minders at the time of booking. This fee is payable by credit card. 50% of this fee is considered a deposit and is non refundable.

6. For on-call assignments, 24 hours notice is required to cancel once a sitter has been assigned. If the required notice is given, 50% of the booking fee/deposit will be charged. If required notice is not given, client will be charged 50% of the first day’s booking fee/deposit, and 50% of the first day’s scheduled service. If Client is merely re-scheduling, the full amount of the booking fees/deposit will be applied to the new assignment date.

7. For overnight assignments, 72 hours notice of cancellation is required once a sitter has been assigned. If required notice is given, client will be charged 50% the booking fee/deposit. If required notice is not given, Client will be charged 50% of the first 24hrs. booking fee and 50% of the first 24hrs. scheduled. If Client is merely re-scheduling, the full amount of booking fees/deposit will be applied to the new assignment date.

8. Once an overnight assignment has begun, should Client return home earlier than the scheduled return date, Client will be charged a minimum of one 24 hour period + the standard hourly rate for each additional hour, or any part of an hour rounded to the nearest 15min., worked prior to Client’s return. If Client returns home less than 24 hrs. earlier than expected, client will pay Sitter the regular hourly rate for the remainder of time that Sitter was scheduled for. If the 24 hour rate is less than the standard hourly rate, Client will pay the lesser of the two.

9. If Sitter shows up to an assignment and is no longer needed, Client agrees to pay sitter for the full 4 hours, including any parking fees, rush fees, cancellation fees, etc. Booking fees/deposits will not be refunded.

10. Final payment for all assignments shall be made at the end of the assignment, paid directly to the sitter (cash or personal check). Client agrees to sign a time card receipt and retain a copy for their records.

11. Client understands and agrees that all arrangements for future assignments will be made through Munchkin Minders. Client is welcome to discuss future assignment availability with Sitter, but will always schedule with Munchkin Minders. Munchkin Minders will exercise it’s right to collect any circumvented or otherwise uncollected fees from both Sitter and Client severally.

12. Holiday rates are calculated by multiplying our regular rates by 1.5. The following is a list of days on which holiday rates will apply: New Year’s Day, Valentines Day (after 5pm), Easter, Independence Day, Thanksgiving Day, Christmas Eve, Christmas Day, and New Year’s Eve* (after 5pm). * Rates for New Year’s Eve will be $21/hour for 1-2 children, and $3/hour for each additional sibling.

13. Client understands that all assignments booked by Munchkin Minders with less than six hours notice will incur an additional fee in the amount of $20.00. Client will pay ½ of this fee by credit card directly to Munchkin Minders with the booking fee, and the other ½ directly to the Sitter at the end of the assignment (cash/check).

14. Add 10 to the booking fee/deposit, and $2 per hour for children with special needs and/or children who are younger than 6 mo. old.

15. Client agrees that all disputes between Client, Munchkin Minders and sitter shall be resolved through final and binding arbitration. The arbitration to be only conducted in San Diego County, California, in accordance with the rules and regulations of the American Arbitration Association. Client, Sitter and Munchkin Minders agree to split the cost of arbitration filing, hearing fees, and arbitrator. Each party bearing own attorney fees. Client agrees that the arbitration shall be instead of any civil litigation. Client waives the right to a jury trial as to such claims. Client further agrees that the arbitrator’s decision shall be final and binding to the fullest extent permitted by law and enforceable by any court having jurisdiction thereof.

End of Sitter agreement.

1. MM placement fees are $500.00 for mini nanny placement (maximum 3 months), $1000.00.00 for part time placement (up to 29 hours per week), $1250.00 for full time placement (30 or more hours per week) and $1500.00 Live in placement (full time or part time).

2. Client agrees to pay a non refundable retainer of $150.00 to MM (cash or check made payable to Munchkin Minders).

3. MM agrees to begin work on Nanny Search immediately upon receipt of retainer.

4. Upon successful search completion, the full amount of retainer will be applied as credit toward total placement fee.

5. Client agrees to pay the remainder of placement fee ($350.00 for mini nanny, $850.00 for part time placement, $1100.00 for full time placement or $1350.00 for live in placement) to MM due upon the first day of Nanny’s employment with Client.

6. Nanny agrees to work for Client for a 6 month (180 day) term unless: Client subjects Nanny to unfair or illegal work conditions, Client does not give Nanny agreed upon minimum number of hours, Client breeches the Nanny Client Work Agreement causing a substantial change in work hours, compensation, and/or duties. Barring these exceptions, if Nanny leaves Client’s employ before completion of 6 months (180 days) service, MM agrees to find and present at least two qualified Nanny replacement candidates at no additional cost to Client. In the event that MM is unable to find two qualified replacement candidates within a period of 3 months, MM will at it’s discretion refund a prorated amount of the original placement fee. MM will not present replacement Nanny candidates or refund any portion of the placement fee if the Nanny leaves before completion of 6 months (180 days) service due to the above listed exceptions.

7. For a mini nanny, employment is not to exceed 3 months(90 days), and is guaranteed for 1 month (30 days). This guarantee becomes null and void should the client subject the nanny to an unfair or illegal work condition, not provide nanny with agreed upon number of hours, eliminate the position, or not pay nanny agreed upon salary. In the event that MM is unable to find two qualified replacement candidates within a period of 1 month, MM will at it’s discretion refund a prorated amount of the original placement fee. MM will not present replacement Nanny candidates or refund any portion of the placement fee if the Nanny leaves before completion of 3 months (90 days) service due to the above listed exceptions.

8. MM is a referral agency only, and is not an employer of Nanny. MM assumes no responsibility or liability for conduct or actions of Nanny. Client has the final say regarding hiring Nanny, and MM recommends that Client take all necessary steps to verify the truthfulness and completeness of any and all information submitted, either by MM or by Nanny directly.

9. Client agrees to hire Nanny using their own judgment, including personal interview, verification of reference checks, utilizing trial work days, etc.

10. Client accepts all responsibility and risks to Client, Client’s family, and/or personal property for injury or loss, arising out of or related to the placement of Nanny with Client.

11. Client understands that all Nanny contact information is private. Client will not contact Nanny in an effort to circumvent MM services or to avoid paying MM fees. Client also agrees not to give Nanny contact information to any third parties. Client understands that MM will hold Client and Nanny severally liable for unpaid fees pertaining to any service relationship established between Client and Nanny (or a third party and Nanny, if Client introduced the third party and Nanny without express permission from MM), for a period of 1 year from the last communication between MM and Client regarding Nanny candidate.

12. Client agrees that all disputes between Client and MM shall be resolved through final and binding arbitration. The arbitration to be only conducted in San Diego County, California, in accordance with the rules and regulations of the American Arbitration Association. Client and MM to split the cost of arbitration filing, hearing fees, and arbitrator. Each party bearing own attorney fees. Client agrees that the arbitration shall be instead of any civil litigation. Client waives the right to a jury trial as to such claims.

With my signature, I hereby state that I have read and understand the Nanny Search Agreement, and I convey my agreement and acceptance of the terms and conditions laid out within said Agreement.
